These Terms and Conditions ("Terms") govern your purchase and use of services from My College Fit List ("we," "us," "our," or the "Company") through mycollegefitlist.com (the "Site"). By purchasing our Service or submitting information through our intake form, you agree to these Terms. If you do not agree, do not use the Site or purchase the Service.

1. Description of Service

My College Fit List provides a personalized, one-time research report identifying college volleyball programs (Division I, II, and III) that may be a realistic athletic, academic, and/or financial fit for the student-athlete described in your intake submission ("the Report"). Depending on the package purchased, the Report includes a list of 25 or 50 programs, fit scoring, and, for the Complete Fit List package, a Reach/Target/Likely ranking, financial fit scoring, sample coach outreach emails, and a recruiting mistakes guide.

The Report is a research product, not a guarantee of recruitment, roster placement, scholarship offer, or admission to any institution. We research and compile publicly available and independently gathered information; we do not represent any college, university, athletic program, or coach, and we cannot control or predict their decisions.

2. Eligibility

Our Service is intended to be purchased by a parent, legal guardian, or an adult (18+) acting on behalf of a student-athlete. By purchasing, you represent that you are at least 18 years old and, if submitting information about a minor, that you are their parent or legal guardian or otherwise authorized to provide that information on their behalf.

3. Ordering, Pricing, and Payment

• Current pricing and package details are listed on the Site and may change at any time without affecting orders already placed.
• Payment is processed securely through Stripe at the time of order. We do not store your full payment card information.
• All prices are one-time fees in U.S. dollars. We do not offer subscriptions under the current pricing structure described on the Site.
• After checkout, you will be directed to our intake form. Your Report cannot be started until the intake form is submitted, and delivery timelines (see Section 4) begin from the date of complete intake submission, not the date of purchase, if the two dates differ.

4. Delivery

We aim to deliver your Report within the timeframe stated for your package at the time of purchase (currently 3-day delivery for The Fit List and 24-hour delivery for The Complete Fit List, measured from complete intake form submission). Delivery timeframes are estimates, not guarantees, and may be affected by factors outside our control, including incomplete or delayed intake information.

5. The 25-School Guarantee

If your Report does not include at least 25 programs that are genuinely realistic fits based on the profile information you provided, you are entitled to a full refund. To request a refund under this guarantee:

• Contact us at [CONTACT EMAIL] within [X days, e.g. 14 days] of receiving your Report;
• Tell us why you believe the fit criteria were not met.

We will review your request in good faith. This guarantee is based on the accuracy and completeness of the information you provided in your intake submission — see Section 6. Refunds under this guarantee are processed to the original payment method within a reasonable time after approval.

Outside of this guarantee, all sales are otherwise final, and we do not offer refunds for change of mind, dissatisfaction with a particular program's fit ranking after the fact, or outcomes related to the athlete's actual recruitment.

6. Accuracy of Information You Provide

The Report is built entirely around the information submitted through your intake form and any materials you provide (such as a transcript or athlete profile). We do not independently verify GPA, test scores, measurables, or other self-reported data. You are responsible for the accuracy of the information you submit, and we are not liable for any inaccuracy in the Report that results from inaccurate or incomplete information you provided.

7. No Recruitment Outcome Guarantee

We make no representation or warranty, express or implied, that any athlete will be recruited, offered a roster spot, offered financial aid or an athletic scholarship, or admitted to any institution identified in a Report. Recruitment outcomes depend on many factors outside our control, including but not limited to athletic performance, program needs, coaching decisions, and admissions criteria.

8. Not Affiliated with the NCAA or Any Athletic Association

My College Fit List is an independent research service and is not affiliated with, endorsed by, or sponsored by the NCAA, NAIA, NJCAA, any athletic conference, or any individual college or university. References to specific schools, conferences, or coaches in a Report are for informational purposes only.

9. Intellectual Property

The Report is prepared for the personal use of the purchasing Customer and the named Athlete's family only. You may not resell, redistribute, publish, or share the Report commercially or with other families for their own recruiting research. All Site content, branding, and materials remain the property of My College Fit List.

10. Limitation of Liability

To the fullest extent permitted by law, My College Fit List and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of opportunity (including missed recruitment opportunities), arising from your use of the Service or reliance on the Report. Our total liability for any claim arising from the Service is limited to the amount you paid for the Report giving rise to the claim.

11. Disclaimer of Warranties

The Service and Report are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Third-Party Services

Our checkout and intake process rely on third-party platforms (Stripe, Google Forms). Your use of those platforms is also subject to their own terms of service, which we encourage you to review.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in California, and you consent to the jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. Changes apply prospectively to orders placed after the updated Terms are posted. The version in effect when you purchase governs that order.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
